
We have advised Lifestyle Properties Development Limited in its successful review application before the Listing (Review) Committee against an earlier decision of the Listing Committee to reject the listing application of the company.
We are the legal advisers of Lifestyle International Holdings Limited and its subsidiary Lifestyle Properties in the proposed spin-off and separate listing of Lifestyle Properties on the Main Board of The Stock Exchange of Hong Kong Limited. Lifestyle Properties is principally engaged in property development and property investment. In the listing hearing held in June 2013, the listing application of Lifestyle Properties was rejected by the Listing Committee. Lifestyle Properties made an application for a review of the Listing Committee’s decision and the review hearing was held before the Listing (Review) Committee on 10 July 2013. The Listing (Review) Committee decided to overturn the decision of the Listing Committee and allow Lifestyle Properties to proceed with its listing application, subject to compliance with certain conditions to the satisfaction of the Listing Division(see the announcement of Lifestyle International on 12 July 2013 as per copy attached). The team was led by our senior partner Peter Sit and Corporate & Commercial partner Joseph Wong and included our senior associates Olson Lai and Emily Wong and trainee solicitor Caddy Mo.
Our Senior Partner C. K. Kwong was invited by the Hong Kong Trade Development Council to deliver a lecture on “Intellectual Property (Trademark, Trade name, Design, Patent) Law and Strategy for Chinese enterprises expanding their businesses abroad” during the Executive Training Course organized for CEOs of enterprises from the Shandong Province by the Hong Kong Trade Development Council during the Shandong week. Mr. Kwong highlighted the intellectual property aspects which enterprises doing businesses abroad should be aware of and practical tips to address those issues.
In his capacity as the President of the Asian Patent Attorneys Association (APAA), C. K. Kwong attended the American Intellectual Property Law Association (AIPLA) Meeting in Seattle from 1st to 3rd May 2013 when he met with Mr. Jeffrey Lewis, Mr. Todd Dickinson and Mr. Jim Crowne (President, Executive Director and Legal Counsel of AIPLA respectively) to exchange news on intellectual property and organization matters. He immediately travelled onto Dallas to attend the International Trademark Association (INTA) Meeting from 4th to 8th May 2013 when he met with Ms. Toe Su Aung and Mr. Etienne Sanz de Acedo (President and newly appointed Executive Director of INTA respectively).
C. K. also met with our firm’s corporate and professional clients there some of which are amongst the Fortune 500.
Our firm continues to assist clients in dealing with the aftermaths of various statutorily sanctioned elections. The election laws in Hong Kong are unique, complicated (contained in several Ordinances) and in some cases, riddled with pitfalls. Hence the joke is, one may think our election law is deterring than encouraging people to take part in public office elections.
Lately we have again successfully applied to High Court (HCMP No.9 of 2013) for relief on behalf of an Election Committee election candidate to amend his election return; without that relief, the consequence could be draconian.
We have just received similar instructions to act for two new clients. We anticipate our knowledge and skill in the election law will help more people in future.

We successfully resisted an application brought to seek leave to appeal to the Court of Final Appeal from a judgment of the Court of Appeal which upheld the order of a professional disciplinary tribunal. The Court of Appeal held that all 3 substantive appeal grounds identified by the Applicant, namely, privilege against self-incrimination, principle of res judicata as well as procedural fairness, were of no merit and hence refused to grant leave to the Applicant.

Our partner Roy Leung represented the Hong Kong Law Society to give a speech in May 2013 on the topic of "Matrimonial Issues and Civil Rights for Mentally Incapacitated Persons" in a professional development workshop attended by social workers of Hong Kong Christian Service, a social service organisation.

President of the Singapore Group of APAA, Ms. Yew Woon Chooi, visited our office on 25th January 2013 to meet with our Partner, C. K. Kwong who is President of APAA. That was followed by a visit by Past President Alonzo Ancheta of APAA from the Philippines to our office on 2nd February 2013. Mr. Kwong extended warm hospitality and exchanged ideas with our guests.
Following his becoming the 10th President of the Asian Patent Attorneys Association (“APAA”) through an open election, our partner Mr. C.K. Kwong visited the World Intellectual Property Organization (“WIPO”) from 20 to 23 January. The APAA now has over 2,300 members from 24 jurisdictions in Asia. WIPO is headquartered in Geneva and is one of the 17 specialized agencies of the United Nations. WIPO currently has 185 members States and administers 24 international treaties. Mr. Kwong was met by Director General of WIPO, Dr. Francis Gurry. Matters concerning the possible cooperation between WIPO and APAA were discussed. The plans of the APAA Academy were discussed with Mr. Yo Takagi (Assistant Director General) and Ms. Carlotta Graffigna (Executive Director of WIPO Academy) followed by another meeting with Mr. James Pooley (Deputy Director General). Mr. Kwong also visited the WIPO Arbitration and Mediation Center and was met by Mr. Erik Wilbers (Director) and Mr. Ignacio Decastro (Deputy Director) [see Photos].
On the same trip to Geneva, Mr. Kwong represented the APAA to participate in the Global Technology Impact Forum (GTIF) organized by the Licensing Executives Society International (LESI) and met with their office bearers (Immediate Past President James E. Malackowski, Current President Chris J. Katopis and President Elect Yvonne Chua) and took part in their discussions. There is a movement to promote and facilitate development of a network and system for advancing mankind through the use of IP licensing and technology transfer. Special emphasis was placed on humanitarian technology transfer.
We prevailed in another appeal to the Court of Appeal which was brought from an order of a professional disciplinary tribunal. Pursuant to the relevant professional rule, our client requested an answer from the Appellant to a specific question in relation to a complaint lodged against him. The Appellant failed to reply promptly and satisfactorily and was disciplined by the tribunal as a result. Upholding the tribunal’s order, the Court of Appeal held that the two major grounds of appeal, namely, privilege against self-incrimination as well as the principle of res judicata, had no merit.
