Appointment of Cindy Fong in Law Society Committees

Our Senior Associate Cindy Fong has been appointed as a member of the Overseas Lawyers Qualification Examination (OLQE) Committee and the Trainee Solicitors Committee (TSC) of the Law Society of Hong Kong, for a term of 1 year respectively.

The OLQE Committee establishes and reviews the competency standard required for overseas lawyers sitting the OLQE, including its syllabi, reading list, information package and policy.

The TSC considers policy matters relating to the trainee solicitor contract system and the training of trainee solicitors, including the quality of training to trainee solicitors, and makes recommendations thereto.

SFKS works closely with the Law Society of Hong Kong in a wide range of legal and social matters, especially to strengthen legal practices, support legal training and continuous professional development, and connect members of the Law Society of Hong Kong with other legal communities in Chinese Mainland and worldwide.

Emily Ip Sharing at HKU

Our Associate Emily Ip shared as a guest alumna at the Industry Insight Sharing and Networking Session, oraganised by the Centre of Development and Resources for Students of the University of Hong Kong.

More than 70 students attended the event to learn about career planning and insights of various industries from 12 guest alumni.

At the event, Emily had a fruitful exchange with undergraduate and postgraduate students on navigating the post-pandemic job-searching scene, exploring her career path as a junior legal practitioner and developing a legal career amidst the rapid development of AI technology.

SFKS recognises the importance of cultivating the power of the youth in the legal industry and is dedicated to empower our next generation of budding legal practitioners.

Memorandum of Understanding for the Strategic Alliance between SFKS and Chainova Technology Limited

SFKS takes pleasure to announce the entering of a strategic alliance with Chainova Technology Limited (“Chainova”), a platform with strong expertise and experience in the technical aspects of Web 3.0 and blockchain technologies, Real-World Asset (“RWA”) tokenization, security token offering (“STO”) and the related technologies.

A signing ceremony for the Memorandum of Understanding of the aforesaid strategic alliance was hosted on 20 March 2026. 

The strategic alliance will leverage the respective strengths and expertise of SFKS and Chainova to provide comprehensive solutions to clients seeking guidance and execution in the areas of Web 3.0, blockchain, stablecoin, digital identity, RWA, STO, tracing and freezing in digital fraud.

SFKS has the history of pioneering technology related market changes.  Today, SFKS is dedicated to transforming clients’ valuable innovations into enforceable rights, with structuring licenses, custody, disclosures, data protection and dispute pathways.

Cindy Fong speaking at Hong Kong Real Property Federation event

Our Senior Associate Cindy Fong spoke at a seminar cum dinner organized by Hong Kong Real Property Federation (HKRPF).

HKRPF provides a wide spectrum of services of company and individual members including property developers, construction companies and senior practitioners of related disciplines such as surveyors, engineers, architects, valuators, lawyers, property managers, bankers and accountants etc., providing professional services to the real estate industry.

In the event, Cindy shared on a High Court adverse possession case where Counsel for the case, Derek Hu, was also a co-speaker for the session.

SFKS echoes the dedication of HKRPF in supporting Hong Kong’s economic development and to assist its members to develop business in the Mainland and across the Strait.

Inauguration Ceremony of Hong Kong Shunde Science and Technology Innovation Liaison Office (Talent Liaison Station)

Our Founding Partner Mr. Peter Sit and Senior Partner Mr. Joseph Wong were honoured to be invited to attend the inauguration ceremony of the Hong Kong Shunde Science and Technology Innovation Liaison Office (Talent Liaison Station).

Led the Foshan Shunde District Science and Technology Bureau, the Liaison Office serves as a bridgehead connecting Shunde with Hong Kong's technology and talent resources. Its key functions include linking science and technology parks, universities, and research institutions in Hong Kong, facilitating the implementation and commercialisation of Hong Kong technological innovations in Shunde industries; attracting high-level talent, young innovators in science and technology, and cutting-edge projects; and to supporting Shunde enterprises seeking Hong Kong listings, fostering connections with the Hong Kong Stock Exchange and venture capital funds to meet financing needs.

Following the inauguration ceremony, our representatives joined government officials and other distinguished guests in discussions on talent recruitment and cooperation initiatives.

Arbitration at the Edge of Insolvency (Asian Dispute Review)

Our Trainee Solicitor Christy Hui’s article, “Arbitration at the Edge of Insolvency: Hong Kong Offshore Strategy after Guy Lam, Sian and Hyalroute”, has been published in the January 2026 issue of Asian Dispute Review.

Focusing on structures in which an immediate holding company is incorporated in the British Virgin Islands (BVI) or the Cayman Islands, this article highlights how variances in approaches to insolvency are no longer merely theoretical but central to strategies for enforcing arbitration clauses. It focuses on how, over the past two years, courts in Hong Kong, the BVI and the Cayman Islands have adopted diverging approaches to arbitration clauses in cases in which creditors seek to wind up debtor companies.

As helpfully compared by Christy, in Hong Kong, arbitration clauses remain a robust shield against liquidation, whereas in the BVI and Cayman Islands, arbitration clauses offer less protection. This asymmetry encourages forum selection by creditors at the debtor’s jurisdiction of incorporation. Hong Kong and BVI/Cayman Islands courts are now apparently moving in divergent trajectories in reconciling arbitration agreements with insolvency remedies. The key insight is not simply that Hong Kong courts are ‘pro-arbitration’ and offshore courts are ‘pro insolvency’. Rather, arbitration clauses now operate as asymmetric tools that may shift bargaining power.

SFKS practices a wide range of dispute resolution, and advises on the drafting and application of arbitration clauses. SFKS also has a vibrant insolvency related legal practice, with abundant exposure to multinational corporations and listed companies with offshore corporate vehicles in different stages of their business cycle.

Promotion of Managing Partner and Senior Partners

Sit, Fung, Kwong & Shum (“SFKS”) is pleased to announce that after some 44 years as SFKS’s managing and senior partner, Peter Sit will step down from that position on 31 December 2025.  He will be succeeded by Roy Leung, Simon Siu and Joseph Wong as SFKS’s new Senior Partners, with Roy Leung also appointed as SFKS’s new Managing Partner, effective from 1 January 2026.

Roy Leung joined SFKS in 2005, and has developed a strong practice in dispute resolutions, with significant experiences in complex civil and commercial litigations and arbitrations, cross-border disputes, insolvency and restructuring, contentious probate actions, white-collar crimes as well as regulatory and enforcement matters.  Roy has been shortlisted as a finalist of the Dispute Resolution Lawyer of the Year 2025 by Asian Legal Business.  Roy is a China-Appointed Attesting Officer, the first-batch Greater Bay Area Lawyer, and a Panel Arbitrator appointed by the Hainan International Arbitration Court, etc.  Roy serves multi-national enterprises on advisory work, as well as private clients on a wide spectrum of legal matters including family issues, trusts and succession planning.  Roy is a frequent speaker for the Law Society, professional bodies, banks and corporate clients.

Simon Siu joined SFKS in 2000, where he has developed a versatile practice encompassing corporate and commercial matters, complex civil and commercial litigations as well as regulatory and compliance cases.  Simon has extensive experiences in listed company transactions, mergers and acquisitions, takeovers, group reorganization and joint ventures.  He also acted and advised in commercial disputes, regulatory investigations and enforcement proceedings.  Simon is also a China-Appointed Attesting Officer and a Greater Bay Area Lawyer specializing in China-related legal matters. He also serves as the honorary legal advisor for various charitable organizations and as independent non-executive director for several listed companies in Hong Kong.

Joseph Wong joined SFKS in 1994 as a trainee solicitor, and has maintained a leading corporate and commercial practice and China practice, with ample experience in initial public offerings, secondary issues, mergers and acquisitions, corporate and capital reorganizations, compliance, corporate governance and complex transactions, including PRC-related commercial transactions. Joseph is a Notary Public and a Greater Bay Area Lawyer.

Roy, Simon and Joseph will be assisted by three other partners Sidney Ho, Jenny Wong and Mathew Liu in the management and operation of SFKS as from 1 January 2026.

The above promotion and changes signifies a historical moment for SFKS. It witnesses a stable and well-planned transition of the first-generation management of SFKS from Peter to a younger and more energetic new management.  These experienced lawyers are well versed with the culture of SFKS, they will bring SFKS forward to a higher level while upkeeping the solemn pledges to serve clients respectfully, to apply law professionally, and to render work effectively.

Peter Sit, in his new capacity as the non-equity Founding Partner, shall continue to unwaveringly support SFKS, serve his own clients and help develop SFKS’s comprehensive legal practice.

Margaret Choi, another partner of SFKS, will continue to oversee SFKS’s vibrant real estate practice.
